These Terms govern your use of Deelva. In short: Deelva is an informational analytics tool that helps you research rental properties. It is not a real estate broker, appraiser, lender, or adviser, and its estimates are a starting point for your own analysis, not advice or a guarantee.

By creating an account, subscribing, clicking to accept, or otherwise accessing or using Deelva (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Service.
You represent that you are at least 18 years old and have the authority to enter into these Terms. If you use the Service on behalf of a company or other entity, you represent that you are authorized to bind that entity, and "you" includes that entity.
Please read Sections 14, 15, and 19 carefully. They include disclaimers of warranties, a limitation of liability, and, where applicable, an agreement to resolve disputes individually. They affect your legal rights.
Deelva is an automated software tool that aggregates data and applies models to help you research and analyze residential rental properties. Deelva provides information and estimates only.
Deelva is not, and does not act as, a real estate broker, real estate agent or salesperson, licensed appraiser, mortgage lender or broker, insurance producer, investment adviser, broker-dealer, accountant, or attorney. Deelva does not list, market, show, sell, buy, lease, or negotiate real property for or on behalf of anyone, does not represent any party in any transaction, and does not receive any commission or transaction-based fee tied to the purchase, sale, lease, or financing of any property.
No agency, fiduciary, or professional relationship of any kind is created between you and Deelva by your use of the Service. You are not Deelva's client in any brokerage or advisory sense, and Deelva owes you none of the duties a licensed professional owes a client. If you want representation or advice, retain your own licensed professionals.
All outputs of the Service are illustrative estimates and forward-looking projections generated from assumptions, models, and third-party data. This includes, without limitation, estimated rent, income, operating expenses, vacancy, cash flow, capitalization rate, cash-on-cash return, internal rate of return (IRR), appreciation, rent growth, recommended offer, offer range, walk-away price, break-even price, verdicts, "Smart Picks," scores, and rankings.
These outputs are estimates, not facts, and not promises. They depend on assumptions (including rent, vacancy, expenses, insurance, taxes, financing terms, interest rates, closing costs, capital expenditures, holding period, and future market conditions) that are uncertain and will differ, possibly materially, from actual results. Past or modeled performance does not indicate future results.
Deelva does not guarantee any rent, occupancy, value, income, expense, price, return, or profit. A verdict, "pick," ranking, or highlighted deal is not a recommendation to buy, sell, lease, or make any offer, and is not an endorsement of any property.
The Service is provided for general informational and educational purposes only. You agree not to make any purchase, financing, investment, or offer decision in reliance, in whole or in part, solely on the Service or any output. You are solely responsible for reviewing and, where appropriate, replacing every assumption with your own independent analysis, and every decision you make is made in your sole discretion and at your own risk.
Any value, rent, offer, walk-away, or break-even estimate produced by the Service is the output of an automated statistical model. It is not an appraisal, appraisal review, broker price opinion (BPO), comparative market analysis (CMA), or opinion of value by a licensed or certified appraiser, and it is not prepared in accordance with the Uniform Standards of Professional Appraisal Practice (USPAP).
You agree not to represent that any Deelva estimate is an appraisal, and not to use any Deelva estimate: (a) in place of an appraisal where one is required; (b) to originate, underwrite, purchase, sell, or securitize any mortgage or other loan, or for any mortgage-lending credit or collateral-valuation decision; (c) to establish or challenge any assessed value for property-tax purposes; (d) in any tax, estate, or gift filing; (e) as evidence of value in any legal proceeding; or (f) for any other lending, tax, accounting, insurance, or legal purpose. For any of those purposes, obtain an appraisal from a licensed or certified appraiser and advice from the appropriate licensed professional.
The Service, including any estimate, score, verdict, offer figure, or ranking, is provided for general informational purposes only and does not constitute investment, financial, tax, accounting, legal, insurance, appraisal, or real estate advice, and is not a recommendation, solicitation, or offer to buy, sell, or hold any property, security, or financial product, or to enter into any transaction.
Any recommendation or ranking reflects the automated application of general criteria and assumptions, not personalized advice tailored to your individual circumstances, objectives, or risk tolerance. Before acquiring, financing, or disposing of any property, consult your own qualified, licensed professionals. You are solely responsible for your own decisions and their consequences.
The Service displays property listings, characteristics, photos, prices, status, tax and public-records data, market indices, and other information obtained from third-party sources, including multiple listing services (MLSs), listing portals, data providers, and public records. This data is deemed reliable but is not guaranteed accurate, and is provided "as is."
Third-party data may be inaccurate, incomplete, duplicated, mispriced, or out of date, and a property shown as available may in fact be pending, under contract, sold, withdrawn, off-market, or never have been for sale. Deelva does not independently verify, control, or warrant third-party data and is not responsible for errors, omissions, or delays in it. Availability, price, terms, and property details must be confirmed directly with the listing broker, seller, or their agent. Use of MLS or IDX data is further subject to the applicable source's rules and disclaimers. Deelva may modify, suspend, or discontinue any data source at any time without notice or liability.
Third-party content, including photos, is owned by its respective providers and is licensed to you only as part of the Service and subject to those providers' terms. You may not scrape, copy, redistribute, sublicense, or publicly display third-party listing content except as expressly permitted by the applicable source.
Flood-zone, FEMA, natural-hazard, climate-risk, and insurance-related information is compiled from government and third-party sources and may be inaccurate, incomplete, outdated, or superseded. It is provided for general informational purposes only.
It is not an official flood-zone determination, elevation certificate, or hazard determination, and it is not an insurance quote, binder, or offer of coverage. It does not establish whether flood or other insurance is required or what it will cost. Flood zones, hazard designations, and insurance rates and requirements change and are property-specific. Before relying on any of it, independently verify the flood zone and all hazard and insurance requirements and costs with FEMA, the applicable authority, a licensed insurance agent, and your lender. Deelva does not sell insurance.
Information about schools, school districts, neighborhoods, points of interest, walkability, transit, and commute times is obtained from third-party and government sources, is provided for general informational purposes only, and may be inaccurate, incomplete, or out of date. School attendance boundaries and enrollment eligibility change and must be confirmed directly with the relevant school district.
Deelva makes no representation or warranty regarding the safety, quality, character, or desirability of any property, neighborhood, school, or area, and you should not rely on the Service for any such conclusion. You are responsible for independently verifying this information and for conducting your own due diligence, including visiting the property and area in person.
Deelva is committed to fair housing. The Service analyzes properties based on physical, financial, and geographic characteristics only. Its estimates and outputs do not take into account, and are not intended to take into account, the race, color, religion, national origin, sex (including sexual orientation and gender identity), familial status, disability, or any other characteristic protected under the federal Fair Housing Act or any state or local law of any owner, occupant, tenant, buyer, seller, or resident.
Neighborhood, school, and similar data are provided for general information only and must not be used as a proxy for the protected characteristics of residents. You are solely responsible for complying with all fair-housing, anti-discrimination, and equal-opportunity laws in your acquisition, marketing, leasing, tenant selection, financing, and management of any property, and you agree not to use the Service to steer, exclude, target, or discriminate on the basis of any protected characteristic. Deelva disclaims all liability for any user's violation of these laws.
If you use Deelva's agent features to generate reports, one-pagers, shareable deal links, or other materials ("Agent Materials") and share them with clients or prospects, you do so as your own work product and on your own professional responsibility.
You agree not to:
You are responsible for safeguarding your account credentials and for all activity under your account, and you must promptly notify us of any unauthorized use. Deelva may investigate suspected violations and may throttle, suspend, or terminate access.
The Service, including its software, models, algorithms, compilations, outputs, and look and feel, and all intellectual property rights in them, are owned by Deelva or its licensors. Subject to these Terms, Deelva grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service and outputs for your own internal evaluation of real estate opportunities. All rights not expressly granted are reserved.
You represent that you have all rights necessary to submit any URL, address, or content you provide, and that doing so does not violate any law or third-party right. You grant Deelva a worldwide, royalty-free license to use and process submitted content to operate, improve, and provide the Service. Any feedback you provide is non-confidential and may be used by Deelva without restriction. Deelva responds to valid copyright-infringement notices and may remove content and terminate repeat infringers.

We may suspend or terminate the Service for non-payment. Prices may change on a going-forward basis with notice.
The Service, including all data, estimates, analyses, scores, and outputs, is provided "as is" and "as available," with all faults and without warranty of any kind. To the maximum extent permitted by law, Deelva disclaims all warranties, whether express, implied, statutory, or otherwise, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade.
Deelva does not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any data, estimate, or output is accurate, reliable, complete, current, or suitable for any purpose. No advice or information obtained from Deelva creates any warranty not expressly stated here.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
To the maximum extent permitted by law, Deelva and its officers, directors, employees, agents, licensors, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost revenue, lost or missed investment or business opportunity, loss on a property purchase or sale, loss of data, or loss of goodwill, arising out of or related to the Service or these Terms, whether in contract, tort (including negligence), strict liability, or otherwise, even if advised of the possibility of such damages and even if a limited remedy fails of its essential purpose.
Deelva's total aggregate liability for all claims arising out of or related to the Service or these Terms will not exceed the greater of (a) the total fees you paid to Deelva in the six (6) months immediately before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability for matters that cannot be limited by law, such as fraud, gross negligence, willful misconduct, or personal injury where prohibited.
You will defend, indemnify, and hold harmless Deelva and its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to: (a) your use of or reliance on the Service or any output; (b) any real estate, financial, or investment decision or transaction you make; (c) your Agent Materials or advice to any client; (d) your breach of these Terms or violation of any law or third-party right; and (e) any content or link you submit. Deelva may assume the exclusive defense and control of any matter subject to indemnification, and you will cooperate.
You acknowledge that real estate investing is inherently risky and carries a substantial risk of loss, and that you assume all risk arising from your use of the Service and any decision you make. To the maximum extent permitted by law, you release and discharge Deelva and its affiliates from any and all claims and damages arising out of or related to the Service, your reliance on any output, or any resulting transaction.
Deelva may modify, suspend, or discontinue the Service or any feature or data source at any time, with or without notice, and without liability. Deelva may also update these Terms; material changes will be notified by email or in-app notice and take effect on the stated date. Your continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service.
Either party may terminate at any time; you by cancelling. Deelva may suspend or terminate your access immediately for any breach, suspected fraud or abuse, non-payment, or as required by law. Upon termination, your license ends and you must stop using the Service. Sections 2 through 12 and 14 through 20, and any accrued payment obligations, survive termination.
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. Before starting any formal proceeding, you agree to first send us a written description of the dispute and attempt to resolve it informally for 60 days.
You and Deelva agree that any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring a qualifying claim in small-claims court. You and Deelva each waive any right to bring or participate in a class, collective, consolidated, or representative proceeding, and each waive any right to a jury trial. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending us written notice, which will not affect any other provision. If the arbitration agreement is unenforceable as to a claim, that claim will proceed in the state or federal courts located in Hudson County, New Jersey, and you consent to personal jurisdiction there.
Any claim must be brought within one (1) year after it arises, to the extent permitted by law, or it is permanently barred.
If any provision of these Terms is held invalid or unenforceable, it will be modified to the minimum extent necessary to be enforceable, or if it cannot be, severed, and the remaining provisions remain in full force. Deelva's failure to enforce any provision is not a waiver. You may not assign these Terms without Deelva's prior written consent; Deelva may assign freely. These Terms, together with any policies referenced here, are the entire agreement between you and Deelva and supersede all prior agreements on their subject. Deelva is not liable for any delay or failure due to causes beyond its reasonable control. You consent to receive communications from us electronically, and electronic communications satisfy any legal requirement that they be in writing. Headings are for convenience only.
